For a long time the rules of SCA Heraldry were you could not register, or be within 3 points of difference of, any 'Real' arms unless you had the legal right to bear them in mundane life for fear of getting in trouble for copyright, trademark, or other infringement.
Well, I don't know how it came about but so long as you are not claiming to be that person or truely descended from them (or some such. I'm not a herald) then you can use any arms you like so long as they are not a direct copy and the 3 points rule is gone for them as well (you still need it for other SCA heraldry).

Be prepared to wait, and change them, and wait, and change them.
Mine took a long while to pass and that was 25 years ago.
Even a simple uncontested name change takes 8 months.
Edit: This last line is about me going from 'Ivan Ivanovitch Serebrenikov" to "Torsteinn Raudskeggr". There have been about 6 Torsteinn's in the SCA and none close to my name, but the bureaucratic wheels still turn slow.

Excellent! Best part is that I am a patient man that can wait a long time (even years) so this to me is a piece of cake. ;)
